Introduction
[1] This dispute arose between siblings concerning the estate of the late Lee Hock Chuan who passed away on 24 March 2021. The plaintiff filed an action to revoke the grant of probate issued to the defendant. The probate was granted based on a Will dated 28 December 2020 ("2020 Will"). The plaintiff alleged that the 2020 Will was invalid, forged and/or fraudulently executed. Additionally, the plaintiff sought a declaration that an earlier Will dated 2 February 2018 ("2018 Will") was valid and legally enforceable.
[2] The deceased had previously made two Wills, the 2015 Will, which remained unsigned and the 2018 Will, which was duly executed. In both these Wills, Rockwills Trustee Berhad was appointed as the sole executor and trustee. However, the 2020 Will named the defendant as the sole executor.
[3] The primary issues before this Court were whether the 2020 Will had been forged or tampered with and whether there were suspicious circumstances that cast doubt on its validity.
