Introduction

[1] This is an appeal by the Appellant against an award dated 22 February 2024 issued by the 1st Respondent, the Co - Operative Tribunal ("Tribunal"), after a full trial in case No T - 02 - 2021. The appeal is made via thisoriginating summons dated 22 March 2024 under s 83(7) of the Co - operatives Societies Act 1993 and O 55A of the Rules of 2012.

[2] On 4 December 2024, I dismissed the originating summons, effectively dismissing the appeal. Here are the grounds of my decision.

Background Facts

[3] The 2nd Respondent is the Royal Malaysian Customs Cooperative Bhd (Koperasi Kastam Diraja Malaysia Bhd).

[4] The Appellant was the chairman of the 2nd Respondent at the material time.

[5] Via two letters of invitation (both dated 8 August 2017), the 2nd Respondent invited Yi Go Group Sdn Bhd ("YGG") to supply containers and cargo handling machinery and equipment ("services") at the 2nd Respondent's cargo depot located at Kota Putra Rubber City, Durian Burung, Kedah. The two letters of invitation were signed by the Appellant as chairman.

[6] YGG prepared and forwarded two quotations (both dated 19 September 2017) in respect of the services to the 2nd Respon
