2025 MarsdenLR 3832
HIGH COURT MALAYA SHAH ALAM
EUM REALTY SDN BHD – Appellant
Versus
INTER FORMULA (M) SDN BHD – Respondent
[Civil Appeal No: BA-12ANCvC-77-12/2024]
A court must conduct a full trial to determine issues of vicarious liability, as these involve mixed questions of fact and law that cannot be resolved through preliminary applications alone.
Headnote:(A) Rules of Court 2012 - Order 33 r 2, Order 15 r 6, Order 18 r 19(1) - Appeal against dismissal of application to determine preliminary issues and remove defendant - Court found that issues of liability and employment status require full trial and cannot be determined solely by contractual documents. (Paras 3, 20, 28)
(B) Vicarious Liability - Determination of liability involves mixed questions of fact and law; thus, a full trial is necessary to assess the nature of the relationship between the parties. (Paras 28, 30)
Facts of the case:
The appellant, a real estate agency, appealed against the Sessions Court's dismissal of its application to resolve preliminary issues regarding its liability for the actions of its agent, the second defendant, in a tenancy dispute involving allegations of fraud. (Paras 1, 4, 6)
Findings of Court:
The court upheld the Sessions Court's decision, indicating that the determination of vicarious liability should be assessed through a full trial rather than a preliminary ruling. (Paras 20, 30)
Issues: The primary issue was whether the Sessions Court erred in dismissing the appellant's application to resolve its liability as a defendant before the full trial. (Paras 3, 15)
Ratio Decidendi: The court held that the nature of the contractual relationship and the determination of vicarious liability required a comprehensive examination of evidence during a full trial rather than a preliminary hearing, thereby affirming the Sessions Court's ruling. (Paras 28, 30)
Result: Appeal dismissed with costs.

9.1 secara vikarius bagi salah laku Defendan Ke-2 terhadap Plaintif;
9.2 di bawah undang-undang am dan statut berkenaan liabiliti ejen hartanah;
