The court ruled on the invalidity of an interim agreement and affirmed entitlement to benefits under statutory provisions despite the lapse of a collective agreement.

Headnote:The appeal concerns claims for termination benefits and wages. Under the Employment Act 1955, the court addressed the applicability of collective agreements. Finding that the interim agreement was invalid, the court held that the complainant was entitled to various benefits. Result of the appeal is that it is allowed with costs.

[1] The complainant (appellant) being dissatisfied with the decision of Director General of Labour ("DGL") which dismissed his claims for termination benefits, wages in lieu of notice and wages in lieu of annual leave has appealed against the said decision. Having heard the arguments, I have allowed his appeal.
