[1] The Petitioner and the Respondent were married in Indonesia on 27 July 2012. There is no child born to the Respondent and the Petitioner during the subsistence of the marriage.
[2] The Petitioner and the Respondent were staying together at No 18, The Residency, Sutera Harbour, Kota Kinabalu, Sabah ("the Sutera Residence") from 27 March 2013 until when the Respondent left to stay at her own residence on 31 July 2013. It is an agreed fact that there has been no resumption of cohabitation between the Petitioner and the Respondent since 31 July 2013.
[3] On 13 October 2014, the Respondent obtained an Order to compel the Registrar of Marriage to register the marriage contracted in Indonesia without the participation of the Petitioner and on 13 November 2014, the said marriage was registered under the Law Reform (Marriage & Divorce) Act, 1976 ("the Act").
[4] On 13 October 2015 and by consent of the parties, the Court granted a Decree of Judicial Separation.
