Introduction

[1] These are cross applications to set aside and enforce an adjudication decision made under the Construction Industry Payment and Adjudication Act 2012 ("CIPAA").

[2] The Plaintiff in Originating Summons No WA-24C-253-11/2019 ("OS 1") and the Defendant in Originating Summons No WA-24C-200-10/2019 ("OS 2") is a private limited company involved in property development business.

[3] The Defendant in OS 1 and the Plaintiff in OS 2 is also a private limited company involved in bored piling and foundation work business.

[4] For easy of reference, the parties will hereinafter be addressed as ASM and EP respectively.

Background And Preliminary

[5] By a letter of award dated 26 September 2019 ("Contract"), ASM appointed EP as the contractor to carry out the Work Package 1: Diaphragm Wall, Contiguous Bored Pile, Earthworks, Piling Works and Basement Structure Works (Basement 2 to LG 1) for the project known as "Cadangan Pembangunan Bercampur 69 Tingkat Yang Mengandungi 7 Blok Pangsapuri Servis (4214 unit) Di Atas Lot 36190, Mukim Petaling, Kuala Lumpur" ("Works")
