2011 MarsdenLR 2698
HIGH COURT MALAYA KUALA LUMPUR
KETUA PENGARAH HASIL DALAM NEGERI – Appellant
Versus
SHIUH DONG INDUSTRIES SDN BHD – Respondent
[Civil Appeal No: R4-14-02-2010]
The taxpayer is entitled to claim double deductions on insurance premiums as the beneficial owner, while interest claims are not deductible when the related assets are not in operational use for income production.
Headnote:(A) Income Tax Act, 1967 - Sections 33(1)(a)(ii) and 113(2) - Appeals regarding deductions of insurance premiums and interest expenses - The court upheld the SCIT's decision allowing double deduction on insurance premiums and disallowed penalties imposed for non-compliance. (Paras 2, 4-13, 17-24)
(B) Tax Deductions - Interpretation of 'Importer' - The interpretation of 'importer' extends to include beneficial ownership and responsibility for cargo, affirming the taxpayer's right to claim under the Income Tax (Deductions of Insurance Premiums for Importers) Rules 1982. (Paras 6, 9-12)
(C) Interest Deductibility - Deductions on interest expenses permissible only if incurred wholly and exclusively for the production of gross income; in this case, the factory was not operational. (Paras 19-22)
Facts of the case:
The appeals stemmed from the Director General of Inland Revenue and Shiuh Dong Industries Sdn Bhd, concerning deductions on insurance premiums and interest expenses related to the business operations of a privately-owned firm dealing in galvanized iron steel sheet.
Findings of Court:
SDI was recognized as the importer entitled to double deductions per established practices; penalties were deemed inappropriate as deductions were justified, while interest expenses were not eligible due to non-operational status of the factory.
Issues: The main issues were the applicability of double deductions for insurance premiums, the classification of SDI as an importer, and the deductibility of interest expenses incurred for funding assets not yet in use.
Ratio Decidendi: The court held that SDI, as the beneficial owner and the efficient cause of importation, qualified for deductions, and further stated that the interest was not deductible since the factory was under construction without producing income.
Result: Appeals dismissed with costs.
