[1] There are 3 applications involved in this proceedings, two filed by the Plaintiff and one filed by the Defendant:
(a) encl 2 is the Plaintiff's Originating Summons for (i) injunctive relief to restrain the Defendant and/or his agent from taking any execution proceedings or from filing a winding up petition against the Plaintiff in the absence of a judgment; (ii) a declaration that the Plaintiff is not responsible for the further warranties in respect of the vehicle, Volkswagen Passat CC, registration no BLM 7770; (c) costs;
(b) encl 14 is the Plaintiff's application is to amend prayer (b) of the Originating Summons (encl 2) in the following terms: ie "for a declaration that the Plaintiff would not be responsible for the extended warranty of a vehicle of the type Volkswagen Passat CC bearing registration no BLM 7770 between 26 November 2013 till 12 February 2015" (prayer (a)); and costs to be borne by the Plaintiff (prayer (b)); and
(c) encl 9 is the Defendant's application to set aside the ex-parte injunctive order granted on 10 March 2015.
