HIGH COURT SABAH & SARAWAK SIBU
NIKODEMUS SINGGAI & ORS – Appellant
Versus
SIBU SLIPWAY SDN BHD & ORS – Respondent
[Suit No: 22-208-07-I]
The judgment clarifies the application of customary land rights amidst statutory land titles and reinforces the principle of indefeasibility once titles are issued.
Headnote:In this case, the court assessed the claims of native customary rights defended by the plaintiffs based on testimony and precedents including the Sarawak Land Code provisions. The court noted the significance of sustaining evidence of continuous occupation and adherence to customary law throughout the proceedings. Ultimately, it varied prior orders reflecting the indefeasibility of land titles issued to the defendants, granting damages to the plaintiffs for loss of rights over these lands.
