HIGH COURT SABAH & SARAWAK BINTULU
KINTOWN CONTRACTOR SDN BHD – Appellant
Versus
TOMETA-MIRA CONCRETE SDN BHD – Respondent
[Civil Appeal No: BTU-12A-2/5-2014]
The Court emphasized that amendments must not prejudice another party and should be made in good faith, as demonstrated by established legal standards.
Headnote:The Appellant appeals the Bintulu Sessions Court's decision allowing the Respondent's application to amend its defense to include a special damages claim. The court finds that the amendment application lacks bona fides since the claim for special damages had been previously struck out for lack of particulars. The amendment is denied due to failure to meet pleading requirements as per Order 20 r 5 of the Rules of Court 2012, and as guided by relevant precedents. Consequently, the appeal is granted with costs.
