Introduction And Background
[1] The Plaintiff, aged 74, sues his 30 year old son's company over a cold milling machine and/or the sale proceeds of the cold milling machine.
[2] The cold milling machine is a recently-purchased new Diesel Cold Milling Machine of Writgen brand ("the Machine") which can be used for premix road works in construction projects. From the documentary evidence produced herein, it appears that the Machine was purchased by the Defendant-company using a bank overdraft facility of RM1,500,000 obtained in the joint name of the father (the Plaintiff Regoovaran) and the son (Vinod Regoovaran) and the bank overdraft facility is secured by the Plaintiff father's Fixed Deposit Certificate in the amount of RM1,500,000.00 which has been pledged to the lender-bank.
[3] The Defendant-company was set up by the son Vinod Regovaran ("hereinafter referred to as "Vinod" or "the son"), with Vinod holding 99% shares and his sister holding 1% shares and with Vinod and his sister as the Directors of the Defendant-company.
