[1] Plaintif, Etiqa Takaful Berhad memohon satu deklarasi bahawa Polisi No: TVP-KA256635-D1 yang melindungi motorkereta No: KBA 9001 bagi tempoh 13 August 2015 hingga 12 August 2016 adalah tidak sah (void) dan tidak boleh dikuatkuasakan (unenforceable) setakat perlindungan terhadap satu kemalangan jalanraya yang berlaku pada 7 April 2016 yang melibatkan motor kereta No: KBA 9001 dan motorsikal No: DAD 2330.
Latar Belakang Kes
[2] Tindakan ini timbul akibat satu kemalangan jalan raya yang berlaku pada 5 April 2016, jam lebih kurang 6.45 petang di Jalan Kota Bharu-Machang-Jeli antara motorsikal no DAD 2330 yang ditunggang oleh Defendan Kedua dengan sebuah motokar no KBA 9001 yang dipandu oleh Siti Norasikin Binti Radzi dan motokar tersebut dimiliki secara berdaftar oleh Defendan Pertama.
[3] Defendan Kedua telah memfailkan tindakan saman di Mahkamah Sesyen Pasir Mas no A53KJ-319-12/2016 untuk menuntut pampasan dan gantirugi akibat daripada kemalangan dengan Siti Norasikin tersebut.
