Brief Facts
[1] The Plaintiff is a Permanent Resident in Malaysia. He is a jeweller and carries on his business at Faiq Jewels Sdn Bhd. He is also a minority shareholder of another jewellery company, KM Oli Mohamed Sdn Bhd ("the Company"), which has a business address at Bangsar Shopping Centre, Jalan Maarof, Kuala Lumpur. The Plaintiff is a former Director of the Company.
[2] The 1st, 2nd and 3rd Defendants are Directors and shareholders of the Company.
[3] The Plaintiff alleged that on or around 19 August 2010, by a Notice (CBOD Pt B pg 40 - 41) to a person named Jubaitha Oli Mohamed ("Jubaitha") and also addressed to other Directors and shareholders of the Company ("the Notice"), the 1st, 2nd and 3rd Defendants produced and published or caused to be produced or published the following defamatory words regarding the Plaintiff:
