2016 MarsdenLR 61
HIGH COURT SABAH & SARAWAK MIRI
MARATIS TAI – Appellant
Versus
SUPERINTENDENT OF LANDS SURVEYS LIMBANG DIVISION & ANOR – Respondent
[Suit No: LMN-21NCvC-1/2-2014]
Native customary rights must be proven through continuous occupation and cannot be claimed retroactively without valid evidence.
Headnote:In this case concerning a claim for native customary rights (NCR) over a parcel of land, the court analyzed evidence related to the claimants' occupation and rights under the Sarawak Land Code, especially referencing sections 84 and 95. The court concluded that the plaintiff failed to prove their native customary rights as alleged, specifically deeming that the claims did not meet the required legal standards for recognition of such rights. The court framed the key issues over the extinguishment of rights and the legal effects of settlement under the Sarawak Land Code. Ultimately, the court ruled that the plaintiff's claims were dismissed due to lack of evidence supporting the assertions of continuous occupation or rights to the land in question.
