JUDGMENT

Nurulhuda Nur'aini Mohamad Nor JC:

Introduction

[1] The accused was charged with trafficking of methamphetamine 755.9 grams in weight, an offence under s 39B(1)(a) of the Dangerous Drugs Act ( DDA ). The 'izin', the charge and the opening statement were all tendered as exhibit P1, P2 and P4 respectively all indicating that only the accused was being charged for this offence.

[2] The said charge in this case reads as follows:

"Bahawa kamu pada 15 Februari 2019 jam lebih kurang 7.06 pagi, di kawasan perlepasan antarabangsa (link bridge) Kastam, aras 4 MTB 64000 KLIA, dalam daerah Sepang, dalam negeri Selangor telah didapati memperedarkan dadah berbahaya disyaki methamphetamine seberat 755.9 gram dan dengan itu kamu telah melakukan suatu kesalahan di bawah s 39B(1)(a) Akta Dadah Berbahaya 1952 yang boleh dihukum di bawah s 39B(2) akta yang sama".

[3] The prosecution called 8 witnesses as follows:

i) SP1 - Dr Saravanan Kumar a/l Jayaram (chemist)

ii) SP2 - Mohd Sazman bin Abdullah (storekeeper)

iii) SP3 - Kpl Noor Laila Binti Abu Hassan (photographer)

iv) SP4 - Kpl Mohammad Jefri Bin Abdullah (raiding officer)

v) SP5 - Kpl Mohd Azhar Bin Abdullah (arresting officer)

vi) SP6 - Inspector He
