2019 MarsdenLR 3187
HIGH COURT MALAYA SHAH ALAM
CHEONG SOK CHIN (P) – Appellant
Versus
TEE KIM TIAM (L) & ANOR – Respondent
[Divorce Petition No: 33-542-09/2014]
The court reiterated that consent orders are rarely disturbed unless exceptional circumstances arise to justify intervention and valid service of notice is crucial for proceedings.
Headnote:This application concerns amendments to a consent order under the Law Reform (Marriage and Divorce) Act 1976, specifically sections 96 and 97, wherein a husband sought to empower a Senior Assistant Registrar to transfer properties to children following his wife's alleged non-compliance. The court found that proper notice wasn't served and therefore, dismissed the application. The primary issues framed include whether service of notice was valid and the discretion of the court to vary consent orders. The judgment reaffirms that consent orders should rarely be disturbed absent exceptional circumstances. Consequently, the application was dismissed.
