[Company Winding Up Petition No: WA-28PW-312-11/2021]
The proposed intervener has a right to be heard when their interests are directly affected by proceedings, ensuring fair adjudication.
Headnote:Statutory provisions under O 15 r 4(2) and O 92 r 4 of the Rules of Court 2012 govern the intervention in applications. The case involves a proposed intervener seeking to join proceedings related to remuneration as joint liquidators. The court found the proposed intervener's rights would be directly affected and justified granting the motion to intervene. The key issue concerns potential prejudice the proposed intervener would face if not allowed to be heard in the proceedings. The final decision allows the proposed intervener to join the applications with the requirement to submit bills to creditors.
