[1] Enclosure 1 was an appeal by the Appellant against the decision of the Sessions Court delivered on 27 October 2020 where, after a full trial, the Sessions Court allowed the claim by the Respondent against the Appellant.

Events Leading To This Appeal

[2] The claim by the Respondent against the Appellant was for a sum of RM421,857.18 (after deducting a sum of RM50,000.00 paid by the Appellant to the Respondent before the issuance of the writ) together with interests and costs.

[3] On 30 August 2019, and following an application by the Respondent pursuant to O 27 r 3 of the Rules of 2012, the Sessions Court entered judgment in favour of the Respondent against the Appellant for the sum of RM350,000.00.

[4] The Appellant appealed to the High Court against the decision of the Sessions Court delivered on 30 August 2019 and the High Court dismissed the appeal. Thereafter, the Appellant appealed to the Court of Appeal and the appeal before the Court of Appeal was pending.

[5] On 27 October 2020, and after a full trial, the Sessions Court allowed the claim by the Respondent and entered judgment in favour of the Respondent against the Appellant for the sum of RM12
