The court affirmed that the Commissioner of Buildings has the authority to grant adjournments for AGMs under the Strata Management Act.

Headnote:This judicial review centers on decisions made by the Commissioner of Buildings which refused to grant an adjournment of the 8th AGM under the Strata Management Act 2013. The court found that the Commissioner had the power to grant an adjournment and that the decisions made were tainted by illegality, irrationality, and procedural impropriety. The court concluded that the applicant's AGM can proceed and declared the meetings valid. The final ruling reads: 'I therefore allowed this judicial review application. I made no order as to costs.'
