2013 MarsdenLR 1461
HIGH COURT MALAYA TAIPING
KUPUSAMY SIDAMBARAM – Appellant
Versus
VERAPAN SINATHAMBY & ORS – Respondent
[Originating Summons No: 24NCVC-14-8-9/2012]
The court confirmed its authority to grant declaratory relief under the Small Estate (Distribution) Act 1955, emphasizing that fraudulent misrepresentation invalidates property transfers.
Headnote:(A) Small Estate (Distribution) Act, 1955 - Sections 13, 417, and 418 - Transfer of estate - Validity of Small Estate Distribution Order granted by Land Administrator challenged due to fraudulent misrepresentation by the Respondents - Court ruled that jurisdiction exists to grant declaratory relief when no remedy is available, as per Section 417. (Paras 22, 23, 25)
(B) Appeal - Right to appeal - Appellant deemed not aggrieved under Section 418 as he was not informed of the distribution hearing; right preserved due to lack of proper notification. (Paras 23, 25, 27)
(C) Fraud - Evidence presented indicated that the First Respondent obtained the estate fraudulently, rendering subsequent transfer invalid, following precedent in Tan Ying Hong v. Tan Sian San. (Paras 29, 31)
Facts of the case:
The Appellant contested the validity of a Small Estate Distribution Order concerning the estate of a deceased relative, citing inadequate notification and fraudulent actions by the Respondents that misled the Land Administrator. (Paras 1-12)
Findings of Court:
The court held that both the initial Distribution Order and the subsequent transfer of property were invalid due to fraudulent misrepresentation, allowing the appeal. (Paras 30, 32)
Issues: The court addressed the power to grant declaratory relief, the applicability of appeal rights under the relevant sections, the necessity of showing familial ties to inherit, and the validity of property transfers. (Paras 14, 22, 27)
Ratio Decidendi: The court emphasized the authority to rectify procedural failures when individuals are deprived of rights through misleading actions, confirming that fraudulent misrepresentations undermine claims of estate distribution. (Paras 29-31)
Result: Appeal allowed with costs RM2,000.00.
