LING HIENG TIONG – Appellant
Versus
HII SIEW CHING (F) – Respondent
[Originating Summons No: SBW-24-44/10-2022 (HC)]
A party without registered estate or interest lacks locus standi to remove caveats under s 177(1) of the Land Code.
Headnote:The applications for removal of caveats lodged against properties were made under s 177(1) of the Land Code (Sarawak Cap 81). The Plaintiff and Defendant, husband and wife, were in divorce proceedings. The court found the Plaintiff lacked locus standi under s 177(1) as they were not registered proprietors of the properties. The issue framed included whether the caveats were valid. The court ruled the applications failed, dismissing them for lack of standing.
