[1] The Accused was charged with committing an offence under s 41(1) of the Road Transport Act, 1987 ("the Act").
[2] The Charge reads in full as follows:
"Bahawa kamu pada 1 Mac 2015 jam lebih kurang 3.30 pagi di Jalan Kuching/Samarahan Expressway, di Daerah Kuching, Dalam Negeri Sarawak sebagai pemandu kenderaan Perodua Viva Nombor Pendaftaran QAT 1579, telah memandu dengan cara yang setelah mengambil perhatian segala hal keadaan adalah merbahaya kepada orang awam iaitu telah hilang kawalan lalu terbabas dan melanggar besi penghadang jalan hingga menyebabkan kecederaan kepada Clearry Anak Alexander Tangai (P) KPT: 950802-13-6460 dan kematian kepada Sebastian Jupong Anak Steel (L) KPT 8: 930425-135703 dan oleh yang demikian kamu telah melakukan kesalahan di bawah s 41(1) Akta Pengangkutan Jalan 1987 dan boleh dihukum dibawah Akta yang sama."
[3] Section 41 (1) of the Act provides that:
"Any person who, by the driving of a motor vehicle on a road recklessly or at a speed or in a manner which having regard to all the circumstances (including the nature, condition and size of the road, and the amount of traffic which is or might be expected to be on the road) is dangerous to the public, causes the death of any person shall be guilty of an offence and shall on conviction be punished with imprisonment for a term of not less than two years and not more than ten years and to a fine not less than five thousand ringgit and not more than twenty thousand ringgit."
[4] After a full trial, the learned Magistrate found the Accused guilty and sentenced him to 3 years imprisonment and a fine of RM5,000.00 in default 7 months imprisonment. The learned Magistrate also ordered the particulars of the offence to be endorsed on the driver's licence of the Accused. A stay of execution of the imprisonment sentence was granted pending the disposal of this appeal.
