[Enclosure 9 - Judicial Review]

Introduction

[1] This is an application for judicial review by the Applicants, seeking the following prayers:

(i) Mendapatkan suatu perintah bahawa kebenaran diberikan kepada Pemohon untuk membuat satu permohonan bagi mendapatkan suatu perintah bahawa Chan Chiew Kuan, yang telah mencapai umur 12 tahun, dapat didaftarkan Kad Pengenalan dan/atau Kad Pengenalan dikeluarkan oleh Defendan dan/atau sesiapa yang dipertanggungjawabkan atas yang sama, kepada beliau dalam tempoh empat belas (14) hari daripada tarikh perintah ini;

(ii) Kos dalam kausa; dan

(iii) Lain-lain relif yang sesuai dan adil serta perlu.

[2] Although crafted in an indirect way, this appears to be an application for an order of mandamus to compel the Respondents to issue a National Registration Identity Card ("IC"‌) to one Chan Chiew Kuan, whom the applicants claim to be their daughter, upon her reaching 12 years of age.

The Applicants, however, filed their submission as though they were applying for an order of certiorari to quash the "decision"‌ of the Respondents. However, that difference is not material to this application for reasons which will be apparent
