LETCHUMAY PALANIAPPAN – Appellant

[1] The plaintiff, Madame Letchumay Palaniappan claims against the defendant for damages; general and special damages due to injuries suffered from a road accident at about 11 am on the 10 June 2005 at KM26, Jalan Kuala Lumpur-Seremban, Kajang, Selangor. The plaintiff was a pedestrian crossing the road and the defendant, Mr Mahalingam Subramaniam, is the lorry driver driving motor lorry, registration number WCB 8396 whom the plaintiff alleged collided into her. The Sessions Court Judge ("SJ") found the plaintiff to be 100% negligent (liable) and dismissed the plaintiff's claim. The plaintiff appealed to the High Court against that decision on both issues on liability and quantum. I allowed the appeal and apportioned liability between the plaintiff at 70% and the defendant 30%.The plaintiff, still dissatisfied, appealed against my decision on both issues.
