HIGH COURT MALAYA KUALA LUMPUR
INNOSEVEN SDN BHD – Appellant
Versus
BIG BLUE CAPITAL (M) SDN BHD & ANOR – Respondent
[Civil Suit No: WA-22NCvC-241-04/2021]

Petitioner Advocates:Tai Yong Fung,Joshua Tan ,Respondent Advocate: Deborah Kaur

Failure to secure the required cleaning services contract under the Joint Venture Agreement justified the return of funds in summary judgment without triable issues raised by defendants.

Headnote:(A) Rules of Court 2012 – Order 14 (Summary Judgment) and Order 18 Rule 19 (Striking Out) – Plaintiff sought return of RM750,000.00 under Joint Venture Agreement (JVA) originally to secure a cleaning services contract, asserting D1 failed to fulfill its obligations – The court found no triable issues raised by defendants challenging the validity of the summary judgment application – Costs of RM4,000.00 each against defendants ordered – Judgment entered for RM750,000.00 against D1 and D2. (Paras 14-26)

(B) Summary Judgment – Rule 14 applications must meet preliminary conditions, shifting burden to defendant to produce triable issues – Defendants failed to elucidate grounds against summary judgment or validate counterclaims – Procedures were properly followed; thus, judgment granted. (Paras 12-18)
