Pengenalan

[1] Perayu/Defendan memfailkan Notis Permohonan (Lampiran 4) di bawah Aturan 3 Kaedah 5(1) Kaedah-Kaedah Mahkamah 2012 bagi Perayu/Defendan diberikan perlanjutan masa untuk memfailkan Notis Rayuan ke Mahkamah Tinggi terhadap keseluruhan Keputusan Hakim Mahkamah Sesyen di dalam guaman No CA-A52-5-12/2021 yang diberikan pada 22 Februari 2023.

[2] Setelah menelitikan kertas-kertas kausa yang difailkan dan setelah menimbangkan penghujahan kedua-dua pihak, Mahkamah telah menolak Notis Permohonan tersebut.

Pertimbangan Dan Penilaian Mahkamah

[3] Pada 22 Februari 2023, Hakim Mahkamah Sesyen (HMS) telah membenarkan tuntutan Plaintif terhadap Defendan di mana Defendan diarahkan untuk membayar sejumlah wang RM273,492.53 beserta faedah atas kadar 5% setahun dari tarikh Penghakiman sehingga penyelesaian penuh dan juga kos sebanyak RM1000.00.
