JUASA HOLDINGS SDN BHD & ORS – Appellant
Versus
ARAH PENDIDIKAN SDN BHD – Respondent
[Companies (Winding Up) No: WA-28NCC-1047-12/2016]
Under the Companies Act, failure to challenge statutory demands of creditors establishes a presumption of insolvency, enabling winding up orders.
Headnote:The court addresses the compliance with the Companies Act 1965 concerning winding up orders. The petitioners, consisting of four companies, claimed the respondent was unable to pay debts totaling RM2,431,091.89 as verified by statutory notice. The court finds no opposition to this claim and confirms petitioners' creditor status. Resulting from the non-compliance, the court rules in favor of the petitioners, allowing the winding up of the respondent company.
