Introduction
[1] Two applications were heard together in this Court with the consent of the parties, namely:
(a) the application by SPNB Aspirasi Sdn Bhd ('SPNB') in Originating Summons No WA-24C(ARB)-27-07/2022 ('OS No 27') to set aside the Ex-Parte Order dated 9 August 2022 under O 69, r 8(7) of the Rules of Court 2012 ('RC 2012'), s 39 of the Arbitration Act 2005 [Act 646] (' AA 2005') and/ or within the existing and/ or implied jurisdiction of the Court, which was granted pursuant to the application by Tunas Manja Development & Construction (KL) Sdn Bhd ('Tunas Manja') to enforce the Final Award dated 29
