[1] The plaintiff's claim against the defendant is for the sum of RM500,000 being purported compensation in consideration of the plaintiff's agreement to be dismissed by the defendant as an executive officer of a company named Metro Koats Technology Sdn Bhd ('MKT').

[2] It is not disputed that MKT had earlier filed suit against the plaintiff vide Civil Suit No 22NCvC-1246-10/2012 ("the 1246 suit") wherein MKT had sued for the return of the company car which the plaintiff had refused to surrender.
