HIGH COURT MALAYA KUALA LUMPUR
DATO MOHAMAD BUSTAMAN ABDULLAH – Appellant
Versus
HARESH SINGH CHAIN SINGH (ENCL 38) – Respondent
[Civil Suit No: 23 NCvC-100-08/2012]

The principle of fair comment protects individuals who publicly express opinions on matters of public interest, and the doctrine of res judicata bars re-litigation of previously adjudicated issues.

Headnote:(A) Rules of Court 2012 - Order 18 Rule 19 - Defamation claim struck out as disclosing no reasonable cause of action - Court found the claim to be scandalous, frivolous, vexatious, and an abuse of process by the plaintiff, based on prior judgments regarding similar allegations - Issues of fair comment and public interest were previously adjudicated unliably - Res judicata applied, preventing re-litigation by plaintiff. (Paras 11-30)

(B) Fair Comment - The defense of fair comment was upheld in prior proceedings, establishing that if a statement is an opinion on a matter of public interest, it is entitled to protection under law. (Paras 15)

(C) Issue Estoppel - Plaintiff barred from pursuing claims on already adjudicated matters regarding the same article under principle of res judicata. (Paras 17)

Facts of the case:
The plaintiff, an advocate, claimed defamation against the defendant, a sports journalist, for republication of a defamatory article and linked statements from his blog, based on prior adverse rulings against similar allegations.

Findings of Court:
The court ruled that the plaintiff's claim lacked a reasonable cause of action and reaffirmed that the defendant's prior defenses were legitimate and applicable.

Issues: Main questions involved were whether the claim against the defendant was sustainable, and whether prior judgments barred re-litigation of the same issues.

Ratio Decidendi: The court held that the principles of fair comment protect expressions of opinion on public interest matters, and prior decisions preclude the plaintiff from advancing identical claims.

Result: Defendant's application to strike out the plaintiff's claim is allowed.
