2021 MarsdenLR 2493
HIGH COURT MALAYA ALOR SETAR
KHAIRUL MOHD NORDIN – Appellant
Versus
PUBLIC BANK BERHAD – Respondent
[Suit No: KA-22NCVC-69-09/2019]
A bankrupt party requires sanction from the Director General of Insolvency to maintain a legal action, and claims without reasonable cause are subject to being struck out.
Headnote:(A) Insolvency Act 1967 – Section 38(1)(a) – Rules of Court 2012 – Order 18 Rule 19(1)(a), (b) and (d) – Appeal by Plaintiff against striking out application by Defendant due to alleged incompetence resulting from bankruptcy, non-existent defendants, lack of duty of care, and expiration of limitation period. (Paras 1, 2, 4, 16, 17)
(B) Claim of negligence failed as Defendant's police report was justified and there was no nexus to Plaintiff's alleged damages, which fell within authorities' purview. (Paras 33, 34, 45)
(C) Principle of res judicata upheld barring relitigation of matters previously adjudicated, establishing that Plaintiff's claim is frivolous and an abuse of process. (Paras 52, 61)
Facts of the case: Plaintiff, a former employee of Defendant, was accused of fraud, leading to criminal proceedings. Court proceedings sought to strike out Plaintiff's claims based on multiple grounds, including bankruptcy. (Paras 4, 16, 26)
Findings of Court: Plaintiff's claims were found to disclose no reasonable cause of action and were ordered to be struck out. (Paras 60, 62)
Issues: Competence of Plaintiff to maintain action post-bankruptcy, naming of Defendants, validity of claims based on tort and procedural defects. (Paras 16, 17, 25)
Ratio Decidendi: Court concluded no reasonable cause of action was presented by Plaintiff; striking out under ROC justified given the circumstances and legal precedents. (Paras 50, 62)
Result: Plaintiff's action was struck out, and Defendant's application allowed with costs awarded. (Paras 62)
