2023 MarsdenLR 1092
HIGH COURT MALAYA KUALA LUMPUR
2WTRADE LLP – Appellant
Versus
ZEPTO EXPRESS BERHAD – Respondent
[Originating Summons No: WA-24-66-12/2020]
A foreign judgment cannot be challenged on its merits in the registering court; it is presumed valid under the Reciprocal Enforcement of Judgments Act.
Headnote:The Defendant sought to set aside the registration of a foreign judgment asserting merits of defense based on non-disclosure and public policy. The court ruled that it could not reassess the merits of the foreign judgment under the Reciprocal Enforcement of Judgments Act 1958, reinforcing that such judgments are presumed valid. The court concluded that the Defendant’s application lacked merit and dismissed it with costs.
