HIGH COURT MALAYA JOHOR BAHRU
RE: ABDULLAH SANI MOHAMMAD; EX PARTE: BANK MUAMALAT MALAYSIA BERHAD
[Bankruptcy No: 29-4088-11-2011]

Formal defects in bankruptcy proceedings do not invalidate the process unless they cause substantial injustice, which does not apply when the error is minor and amendable.

Headnote:(A) Bankruptcy Act 1967 - Section 3(1)(i) - Section 5(1) - Section 131 - Appeal against dismissal of application to set aside bankruptcy petition based on misstatement of act of bankruptcy date - Act of bankruptcy occurred upon non-compliance with bankruptcy notice, determined by interpretation of rules. (Paras 2, 5, 7, 9)

(B) Formal defects in bankruptcy proceedings - A mistake as to the date of the act of bankruptcy is deemed a formal defect unless it causes substantial injustice, which was not established herein. (Paras 9, 11)

(C) No substantial injustice determined by the misstatement, and hence, Section 131 validates the proceedings despite the formal defect. (Paras 12, 13)

(D) Appeal dismissed with costs. (Para 14)

Facts of the case:
The judgment debtor appealed against the decision of the Senior Assistant Registrar dismissing the application to set aside a bankruptcy petition based on an incorrect date for the act of bankruptcy stated in the creditor's petition. The bankruptcy notice was served on 19 November 2011, with the debtor arguing a different date based on rules interpreting compliance time.

Findings of Court:
The Court found that the misstatement regarding the bankruptcy date was a mere formal defect and did not result in any substantial injustice, thereby supporting the validity of the bankruptcy petition per Section 131.

Issues: The appeal primarily addressed whether the misstatement regarding the date of the act of bankruptcy invalidated the bankruptcy petition.

Ratio Decidendi: The Court reasoned that since the misstatement was merely formal and did not cause substantial injustice, it did not invalidate the bankruptcy petition proceedings, in line with Section 131 of the Act.

Result: The appeal was dismissed with costs of RM1,000.00.
