Introduction

[1] There are three (3) suits before this Court, which have been consolidated, vide a Court order dated 23 June 2014:

(i) Admiralty In Personam No: 27NCC-17- 04/2014

(ii) Admiralty In Rem No: 27NCC-33-05/2014

(iii) Admiralty In Rem No : 27NCC-34-05/2014

[2] In Admiralty In Personam No: 27NCC-17- 04/2014, the Plaintiff, PT EKA NUSA BAHARI ("the Plaintiff"), is a company incorporated in Indonesia, and sued the Company, SEASIA SHIPYARD SDN BHD (In Liquidation) ("the Defendant") claiming for possession of two (2) vessels, Hamdam 1 and Hamdam 2, and seeks a declaration that:

(i) the ownership of the two (2) units of vessels 'HAMDAM 1" and "HAMDAM 2" are that of PT Eka;

(ii) an Order that the custody and posse
