[Criminal Application No: WA-44-137-08-2018 & WA-44-167-10-2018]
Judicial review of detention orders under the Dangerous Drugs Act is limited to procedural compliance, not the merits of the decision.
Headnote:Statute Analysis: The application involves a Writ of Habeas Corpus under the Dangerous Drugs (Special Preventive Measures) Act 1985 (Act 316), questioning a Detention Order made by the Minister. Facts of the Case: The applicant was detained for two years on a Detention Order issued on 13 March 2018 after being arrested in January 2018.
Findings of Court:
The Court found no procedural violations in the inquiry or the issuance of the Detention Order and upheld the Minister's decision.
Issues: The Court framed the main question as whether procedural compliance was maintained in the issuance of the Detention Order per the Act's requirements.
Ratio Decidendi: The Court reasoned that any prior irregularities are irrelevant once a valid Detention Order is made under a lawful provision.
Result: The application is dismissed.
