INDUSTRIAL COURT IPOH
YEW NIN HUAT – Appellant
Versus
SANOFI-AVENTIS (MALAYSIA) SDN BHD – Respondent
Award No: 323 Of 2023 [Case No: 10/4-437/22]
The employer must demonstrate bona fide reasons for redundancy during retrenchment, and unions must act on the principles of management prerogative and compliance with statutory provisions.
Headnote:The judgment concerns the dismissal of Yew Nin Huat under the Industrial Relations Act 1967 following an alleged redundancy by Sanofi-Aventis (Malaysia) Sdn Bhd on 15 July 2021. The court upheld that the claimant's position was genuinely redundant post-restructuring, and the dismissal was not without just cause. Key issues addressed included whether the redundancy was bona fide and if the retrenchment complied with accepted practices. The company's restructuring was deemed legitimate, and the claimant willingly accepted severance rather than pursuing alternate positions offered. Consequently, the claimant's appeal was dismissed.
