2023 MarsdenLR 2111
INDUSTRIAL COURT IPOH
GEORGIANA CHAI SIAW VUN – Appellant
Versus
LEKAMAS SDN BHD – Respondent
Award No: 214 of 2023 [Case No: 10/4-2526/21]
A demotion based on misconduct does not constitute a breach of the employment contract sufficient for constructive dismissal when the employer follows proper inquiry procedures.
Headnote:The court analyzed the statutory provisions, particularly s 20(3) of the Industrial Relations Act 1967, which addresses constructive dismissal claims. The Claimant alleged she was constructively dismissed due to a fundamental breach of her employment contract by the Company, which conducted two domestic inquiries resulting in her demotion. The court found that the Claimant failed to establish the allegations of constructive dismissal. The pivotal questions were whether the Claimant was constructively dismissed and if the Company's actions were justifiable. The court determined that the disciplinary actions imposed were reasonable and within the Company's rights, concluding that the Claimant voluntarily resigned without any fundamental breach occurring. Thus, the Claimant's claim for constructive dismissal was dismissed.
