RUJUKAN:

Q: What are your prepare to this Honourable Court.

A: I humbly pray to this Honourable Court to award lost wages together with reasonable compensation for the loss, suffering and humiliation I had to go through for something I did not commit.

Semasa disoal balas peguam pihak Syarikat turut menanyakan:

Q: Refer to Question and Answer 30. You are not asking for reinstatement.

A: No.

"where a workman, irrespective of whether he is a member of a trade union of workmen or otherwise, considers that he has been dismissed without just cause or excuse by his employer, he may make representations in writing to the Director General to be reinstated in his former employment; the representations may be filed at the office of the Director General nearest to the place of employment from which the workman was dismissed."

Dalam kes Hong Leong Equipment Sdn. Bhd v. Liew Pook Chuan and another [1997] 1 CLJ 686; [1996] 1 MLJ 481 di muka surat 514:

"Reinstatement is the primary remedy in Industrial Law, and an acceptance of it or an unreasonable rejection of by the workmen must be treated as having put an end to the dispute".

Y.A. Haidir Mohd. Nor dalam kes ini telah memutuskan bahawa:

"1) The representations by the Minister to the Industrial Court under s. 20(3) of IRA must necessarily confine to representations for reinstatement by virtue of s. 20(1). The power to make an award by the Industrial Court is provided by s. 30(1). It would clearly appear therefore that if a workman does not require reinstatement, there would not be a reference to the Industrial Court under s. 20(3) of the IRA.

2) The Industrial Court ...

3) The learned Chairman ...

4) The decision of the Industrial Court ...

5) The respondent clearly could not come within the pr
