AWARD

The parties to the dispute are HKT (Malaysia) Sdn. Bhd. (the company) and Gan Seng Kee (the claimant). The dispute is over the dismissal of the claimant by the company.

The matter was set down for hearing on 7 December 2004. However on the date of hearing both parties informed the court that they have settled the matter amicably.

The terms of settlement are as follows:

1. The company agrees to pay the claimant the sum of RM38,000 as full and final settlement.

2. The above sum will be paid on or before 15 January 2005 to the claimant through Malaysian Trade Union Congress (MTUC) Johor.

3. The claimant will accordingly withdraw the above matter from the Industrial court.

The court hereby records consent award in terms of the settlement.
