AWARD

This case came up before me for mediation on 09.12.2004. Accordingly the Court conducted mediation with counsel of both parties present as observers.

2. The mediation was a success. The parties agreed to a full and final settlement of the case on the following terms and conditions:-

(i) By consent, the Company will pay the Claimant four equal monthly instalment of RM2,700.00 each as full and final settlement. The first cheque is to be dated 20.12.2004 followed by three other cheques with the same amount of RM2,700.00 each which are dated 20.01.2005, 20.02.2005 and 20.03.2005 respectively.

(ii) In the event that any of the cheque is dishonoured for lack of fund, the Claimant will have the liberty to file a fresh his claim against the Company.

(iii) The Claimant and the representative of the Company, Mr. Suntoro and Mr. Ken Woon confirmed the above terms and conditions in the presence of their respective Counsel.

(iv) Accordingly the Court hand down the final award of this case on the above terms and conditions.
