[1] Ini adalah permohonan untuk satu perintah ketidakpatuhan di bawah s 56(1) Akta Perhubungan Perusahaan 1967 dalam Borang S yang difailkan pada 19 Jun 2023 di bawah Kaedah 24A Kaedah-Kaedah Mahkamah Perusahaan 1967 berkenaan No Kes: 22(11)/4-762/22 (No Award: 426 Tahun 2023) yang diperturunkan pada 1 Mac 2023 di antara Atiqah Farhana binti Khazin dengan Helios Photovoltaic Sdn Bhd.
[2] Satu aduan telah difailkan oleh Pengadu terhadap peruntukan di dalam Award Persetujuan berkenaan tidak dipatuhi oleh pihak Responden di mana Mahkamah telah mengarahkan Responden untuk membayar kepada Pengadu jumlah sebanyak RM39,486.48 dalam 3 ansuran bulanan, iaitu:
(a) RM13,192.16 pada atau sebelum 31 Mac 2023;
(b) RM13,192.16 pada atau sebelum 30 April 2023;
(c) RM13,192.16 pada atau sebelum 31 Mei 2023.
[3] Pengadu memaklumkan kepada Mahkamah bahawa pihak Responden telah gagal mematuhi Award Persetujuan tersebut dan 2 ansuran tidak dibayar sehingga hari ini. Pengadu memohon agar pihak Responden mematuhi Award Persetujuan tersebut.
