By way of an ex parteoriginating summons dated 23 December 1996 and filed on the same day as reflected in encl. 4, the plaintiff sought for the following orders:
(a) that the Registrar's caveat entered on October 28, 1987 videJilid No: 288 Folio 39 Presentation No: 3556/87 for 4/10 of the property held under Grant No: 26621 Lot No: 5128, Mukim Plentong be discharged or removed.
(b) that a declaration be given that 4/10 of the property held under Grant No: 26621 Lot 5128, Mukim Plentong is owned by the plaintiff.
(c) that costs of this application be costs in the cause.
The ex parteoriginating summons in encl. 4 involved the plaintiff and the defendant only and it was supported by an affidavit of the plaintiff himself that was dated 23 December 1996 and filed on the same day as shown in encl. 2. A certificate of urgency was also filed by Miss Susan Yeap Shuh Sin, learned counsel for the plaintiff, and there it was stated that the plaintiff had signed a sale and purchase agreement with Finest Vision Sdn Bhd on 26 November 19
