[1] The appellant was charged for trafficking in 265.61 grams of drugs comprising 70.20 grams of heroin and 195.41 grams of monoacetylmorphines in front of Hotel Desa Jaya, Jalan Permatang 5, Taman Desa Jaya, Ulu Tiram in the District of Johor Bahru in the State of Johor Darul Ta'zim on 2nd May, 2002 at 4.30pm an offence under s 39B(1)(a) of the Dangerous Drugs Act 1952 ('Act') punishable under s 39B(2) of the Act.

[2] At the end of the defence case the appellant failed to raise any reasonable doubt in the prosecution's case and was found guilty as charged by the learned High Court Judge and sentenced to death. His ensuing appeal to the Court of Appeal was dismissed hence this appeal to the Federal Court of Malaysia.
