Facts of the case:
The claimant was employed by a company as an electrical technician and sustained an electrical shock while working on a machine, after which he tested positive for morphine-implicated on his drug report. His dismissal followed due to a violation of the company's strict policy on drugs, despite his claims of taking over-the-counter medications. (Paras 1-5)

Findings of Court:
The court found sufficient grounds for the dismissal, confirming that the claimant knowingly ingested substances that led to the drug test results, thereby justifying the company's actions under employment law and policy. (Paras 26-27)

[1] Kes ini yang merupakan rujukan dari YB Menteri Sumber Manusia di bawah s 20(3) Akta Perhubungan Perusahaan adalah terbit dari pembuangan kerja penuntut oleh pihak syarikat pada 7 Ogos 2008. Penuntut bekerja dengan syarikat sebagai "electrical technician" bermula dari 9 Julai 2007 dengan gaji hakiki RM2000 sebulan.

[2] Mengkut fakta kes, pada 25 Julai 2008, penuntut telah terkena renjatan eletrik semasa sedang bekerja iaitu membaiki "wielding machine". Menurut keterangan penuntut, mesin tersebut tidak mempunyai "off on switch". Beliau telah membuka soket dan memasukkan "test-pen" untuk memastikan tiada aliran eletrik dan telah terkena kejutan. Selepas itu penuntut telah pergi mendapatkan rawatan di klinik di dalam syarikat dan kemudian memaklumkan kejadian kepada Encik Azwadi.

[3] Pada 28 Julai 2008 Penuntut telah diarahkan oleh syarikat untuk menjalani pemeriksaan kesihatan di KPJ Selangor Specialist Hospital dan penuntut telah pergi pada 29 Julai 2008. Pada 30 Julai 2008, syarikat telah menerima laporan kesihatan penuntut dan laporan itu menyatakan ujian air kencing atas penuntut mendapati ia mengandungi "morphine". Laporan perubatan berkaitan adalah sepertimana di ms 4 hingga 7 COB.

[4] Penuntut kemudian telah diberhentikan kerja oleh syarikat pada 7 Ogos 2008 melaui surat sepertimana di ms 8 COB. Penuntut diberhentikan kerana telah melanggar "Alcohol and Drugs Policy" seperti yang dikemukakan sebagai COB2. Perkara 2.2 polisi berkenaan adalah seperti berikut:

The use, possesion, concealment, transportation, purchase, promotion or sale of Prohibited Substance on company premises or Third party premises is strictly forbidden. Furthermore, being under the influence of Prohibited Substances at any time whilst working for the company or whilst on company premises or Third Party premises is strictly prohibited.

[5] Menurut keterangan penuntut, pada 29 Julai 2008 sebelum air kencing di uji beliau telah memberitahu jururawat di hospital tersebut beliau ada makan "panadol", ubat selsema dan ubat batuk kerana kurang sihat. Pada 5 Ogos 2008, apabila diberitahu oleh Encik Susiman bahawa air kencing beliau adalah positif "morphine", penuntut telah dengan sendiri pergi semula ke hospital yang sama dan membuat ujian air kencing sekali lagi. Kali ini laporan adalah negatif. Keputusan ujian adalah seperti di ms 16 CLB. Menurut penuntut laporan yang kedua enggan diterima oleh Bahagian Sumber Manusia Syarikat. Selepas diberhentikan kerja, beliau telah pergi mendapatkan laporan doktor pada 8 Ogos 2008. Laporan tersebut adalah seperti di ms 17 CLB.

[6] Menurut penuntut juga, beliau telah mengambil "panadol" ubat selsema dan ubat batuk isterinya dan kemukakan "time-slip" isterinya bertarikh 30 Jun 2008 sebagai bukti.

[7] Penuntut dalam hujahnya menyatakan bahawa beliau telah memberikan penjelasan kemungkinan bagaimana "morphine" boleh hadir dalam air kencingnya iaitu ia telah mengambil ubat untuk batuk dari isterinya yang diperolehi dari klinik. Penuntut juga berkata pihak syarikat adalah terburu-buru dalam memberhentikan pekerjaannya dan tidak mengambil kira laporan doktor yang kedua yang diperolehi oleh penuntut. Syarikat juga telah memberhentikan penuntut dengan tidak melalui "due process" iaitu tidak mengadakan siasatan dalaman.

[8] Penuntut merujuk kepada kes-kes Perwaja Steel Sdn. Bhd. v. Zainuddin Ngah ; [1998] 3 ILR 792 (Award No. 612 of 1998) dan Kesas Sdn. Bhd. v. Rahmat Mahmud ; [2003] 2 ILR 109 (Award No. 280 of 2003) . Pihak syarikat pula dalam hujahnya bergantung kepada keputusan dalam kes Malaysian Airline System Bhd. v. Samson Anuar Haron ; [2003] 3 ILR 1407 (Award No. 880 of 2003) dan Kamisan Abu Bakar v. Allied Pickfords (M) Sdn. Bhd. ; [2009] 1 ILR 497 (Award No. 20 of 2009) .
