Fakta Kes
[1] Pihak-pihak dalam pertikaian ini adalah Chen Ka Fatt (Pihak Menuntut) dan Maybank Berhad (Pihak Bank). Pertikaian di hadapan Mahkamah ini timbul dari rujukan oleh YB Menteri Sumber Manusia, Malaysia di bawah s 20(3), Akta Perhubungan Perusahaan 1967 berkaitan dengan pembuangan kerja Pihak Menuntut pada 30 Januari 2012.
[2] Pihak Menuntut mula berkhidmat dengan pihak Bank pada 27 April 1981 sebagai Assistant Cashier and Typist (rujuk surat tawaran pekerjaan oleh Bank bertarikh 4 Mei 1981). Pihak Menuntut telah disahkan dalam jawatannya melalui surat bertarikh 18 Julai 1981. Pada masa pembuangan kerja ini, Pihak Menuntut memegang jawatan sebagai Special Grade Clerk dan gaji terakhir beliau adalah RM4033.00.
[3] Pada masa material, Pihak Menuntut adalah ahli Exco NUBE dan juga memegang jawatan sebagai General Treasurer NUBE.
[4] Sekitar hujung bulan Mei 2011, Pihak Menuntut telah menghadiri International Labour Organisation (ILO) Conference di Geneva, Switzerland. Pada 18 Jun 2011, pihak bank telah mendapat maklumat bahawa semasa menghadiri persidangan di Geneva tersebut, Pihak Menuntut dan beberapa orang pekerja yang lain telah memegang dan mempamerkan banner yang mengandungi penyataan "Maybank Robs Poor Malaysian Workers" di premis United Nations dan di luar bangunan Ibu pejabat United Nations di Geneva. Gambar- gambar yang menunjukkan Pihak Menuntut dan pekerja-pekerja lain memegang banner tersebut semasa Persidangan ILO tersebut telah diambil dan kemudiannya telah dimuatnaik ke dalam website NUBE iaitu www.nube.org.my..
[5] Ekoran dari itu Pihak Bank telah mengeluarkan surat tunjuk sebab bertarikh 11 Julai 2011 (halaman 7-8, Ikatan A) kepada Pihak Menuntut. Dalam surat tunjuk sebab tersebut, Pihak Menuntut telah diminta untuk mengemukakan penjelasan terhadap dakwaan salahlaku-salahlaku yang dikatakan telah dilakukan oleh Pihak Menuntut iaitu:
i. You had, between 30 May 2011 and 10 June 2011, while in the employment of the Bank, caused disrepute to the image and reputation of the Bank by holding and displaying a banner bearing false and defamatory words "Maybank Robs Poor Malaysian Workers" in the premises of the United Nations building in Geneva during the International Labour Conference.
ii. You had, between 30 May 2011 and 10 June 2011, while in the employment of the Bank, caused disrepute to the image and reputation of the Bank by holding and displaying a banner bearing false and defamatory words "Maybank Robs Poor Malaysian Workers" outside the United Nations Headquarters in Geneva.
iii. You had, on 28 June 2011, while in the employment of the Bank, caused disrepute to the image and reputation of the Bank, when photographs of yourself displaying a banner bearing false and defamatory words "Maybank Robs Poor Malaysian Workers" in the premises of the United Nations building in Geneva and outside the United Nations Headquarters in Geneva were placed on the NUBE website known as www.nube.orq.my.
[6] Pihak Menuntut telah menjawab kepada surat tunjuk sebab tersebut melalui surat bertarikh 28 Julai 2011 (halaman 11, Ikatan A). Pihak Bank tidak berpuashati dengan penjelasan yang diberikan oleh Pihak Menuntut, dengan itu telah mengeluarkan Notis Siasatan Dalaman bertarikh 23 Ogos 2011 (halaman 12-13, Ikatan A) untuk menyiasat pertuduhan-pertuduhan seperti yang dinyatakan dalam surat tunjuk sebab bertarikh 11 Julai 2011 tersebut.
[7] Siasatan dalaman yang sepatutnya dijalankan pada 8 September 2011 telah ditangguhkan sebanyak dua kali atas permohonan Pihak Menuntut kerana Pihak Menuntut meme
