AWARD

This complaint under section 56(1) of the Industrial Relations Act 1967 (the Act) by Mat Desa Bin Saad (the 1st complainant) and Ismail Bin Hamid (the 2nd complainant) is that Langkawi Ferry Services Sdn Bhd (the respondent) has failed to comply with Award No. 942 of 2008 in case No. 18/4-564/07 requiring the respondent to pay to the 1st complainant the sum of RM44,701.30 and to the 2nd complainant the sum of RM53,252.10.

On the hearing date of the complaint one Mr. Harmesh Singh mentioned on behalf of Messrs Anoop & See, said to be the solicitors for the respondent. This firm of solicitors is not even on record inasmuch as no Warrant of Authority (Form B) has been filed. Mr. Harmesh Singh sought a postponement the reason being that the respondent had filed an application for judicial review of the said Award in Alor Star High Court Case No. 05-25-8-2008 as well as for an order for stay of these Industrial Court proceedings. He informed the Court that both applications had been fixed for hearing on 22nd March 2008. The Court disallowed the request for postponement since no stay order had actually been obtained and directed that the hearing be proceeded with.
