Claimant's Pleaded Case
[1] The Claimant commenced employment with the Company on 29 June 2015 as Financial Reporting Analyst with a monthly basic salary of RM 4500.00. The Claimant was confirmed in her position effective 27 December 2015.
[2] The Claimant contended that the Company's Chief Financial Officer (CFO) one Cheok Huei Shian and the Financial Controller (FC), one Edith Chin assured her that if she could clear the mess and stabilize the Treasury department, she would be promoted as an Assistant Manager.
[3] The Claimant alleged that her performance review for 2015 was carried out by the CFO and FC where she was mostly rated outstanding but in the conclusion they marked down her performance and instead of promoting her as the Assistant Manager for Treasury as promised, they brought one Yap Shwe Pyng who was neither experience in corporate finance or accountancy for the position as well as to be the Claimant's superior.
[4] The Claimant contended that due to the biased performance evaluation, she not only lost the promotion but also her annual increment and bonus, where instead of getting the assured increment of between RM500.00 - RM1000.00, she only rece
