HIGH COURT MALAYA SHAH ALAM
LOW PECK LIM – Appellant
Versus
LOW PECK SANG & ORS – Respondent
[Originating Summons No: BA-24NCVC-2395-12-2023]

The court ruled that a co-proprietor can seek termination of co-proprietorship and sale of property without prior partitioning, with the majority's view not being a decisive factor.

Headnote:(A) National Land Code - Section 145(2)(c) - Rules of Court 2012 - Application for termination of co-proprietorship and sale of land - Court held that the intention to sell land can be pursued without prior partition application - Majority view of co-proprietors not determinant for termination - Reliefs granted for sale and distribution of proceeds among co-proprietors. (Paras 1, 3, 22, 29, 30)

(B) Ethical conduct of advocates - Allegations of ethical breaches by the Plaintiff deemed irrelevant for striking out application - Ethical violations warrant investigation but do not affect current proceedings. (Paras 15, 18, 19)

Facts of the case:
The Plaintiff, a sibling, sought to terminate co-proprietorship of family land due to disagreements with his siblings over its management and potential sale, seeking relief under the National Land Code. (Paras 1, 8, 21)

Findings of Court:
The Court recognized the Plaintiff's right to seek termination of co-proprietorship and sale of the land, allowing the application based on the merits of the case. (Paras 29, 30)

Issues: Whether the Court should exercise discretion to terminate co-proprietorship and allow sale of the land, and the relevance of ethical allegations against the Plaintiff. (Paras 3, 16)

Ratio Decidendi: The Court found that the Plaintiff's intention to sell the land was legitimate and did not require prior partitioning, emphasizing that the majority's view in co-proprietorship does not preclude termination. (Paras 26, 29)

Result: Application to terminate co-proprietorship and sell the land allowed; costs awarded to the Plaintiff.

JUDGMENT

Choong Yeow Choy JC:

Introduction

[1] The distinctiveness of this case stems from the fact that the six siblings concerned are not fighting over their shares in their late parents' estate. Their shares and entitlement are not in dispute. The overriding disagreement relates to the question of whether the estate in the form of a piece land jointly owned by the six siblings ought to be disposed of or that they should continue to hold the said land as co-proprietors.

[2] The Plaintiff has commenced this Originating Summons application seeking an order for the said land to be sold pursuant to s 145(2)(c) of the National Land Code and O 31 of the Rules of Court 2012. Of the five Defendants, only three of the five Defendants are fervently contesting the application

The Prevailing Issue

[3] The central issue in this Originating Summons is whether this is a proper case for this Court to exercise its discretion to terminate the co-proprietorship pursuant to s 145(2)(c) of the National Land Code and direct that the said land be sold pursuant to O 31 of the Rules of Court 2012.

The Parties

[4] The Plaintiff and the Defendants are siblings.

[5] The Plaintiff and the 1st, 2nd and 3rd defendants are brothers while the Fourth and 5th defendants are their sisters.

Low Peck Lim (Plaintiff) - 19.44%

Low Peck Sang (D1) - 19.44%

Low Peck Chuan (D2) - 19.44%

Low Peck Guan (D3) - 19.44%
