[1] Ini adalah permohonan untuk satu perintah ketidakpatuhan di bawah s 56(1) Akta Perhubungan Perusahaan 1967 dalam Borang S yang difailkan pada 22 Jun 2023 di bawah k 24A Kaedah-Kaedah Mahkamah Perusahaan 1967 berkenaan No Kes: 7/4-2402/2019 No Award: 1443 Tahun 2021 [[2021] MELRU 1443]) yang diperturunkan pada 4 Oktober 2021 di antara Tan Teik Sheen dengan Early Infinity Holdings Sdn Bhd (Substituted with Alpha Cen Sdn Bhd).
[2] Sebelum Mahkamah mendengar permohonan ketidakpatuhan oleh Pengadu tersebut, peguam Pengadu telah membuat permohonan agar nama syarikat Responden dibuat pembetulan selaras dengan carian yang dibuat di SSM dimana nama sebenar syarikat Responden adalah "ALFA CEN SDN BHD" dan bukan "ALPHA CEN SDN BHD" seperti dalam borang S.
[3] Permohonan peguam Pengadu untuk menukar nama syarikat Responden daripada "ALPHA CEN SDN BHD" kepada "ALFA CEN SDN BHD" adalah dibenarkan.
[4] Satu aduan telah difailkan oleh Pengadu terhadap peruntukan di dalam Award berkenaan tidak dipatuhi oleh pihak syarikat Responden di mana Mahkamah telah mengarahkan syarikat Responden untuk membayar kepada Pengadu jumlah sebanyak RM63,600.00 setelah tolakan statutori dibuat (jika ada) dan pengembalikan kerja Pengadu dalam tempoh 30 hari dari tarikh Award tersebut.
[5] Pengadu memaklumkan kepada Mahkamah bahawa pihak syarikat Responden telah gagal mematuhi Award tersebut dan tiada pembayaran dilakukan sehingga hari ini. Pengadu memohon agar pihak syarikat Responden mematuhi Award tersebut.
