AWARD

This case was fixed for mention on 17 September 2001, 5 October 2001, 1 November 2001, 9 November 2001, 28 April 2003, 5 March 2004, 28 May 2004, 13 December 2004 and 20 December 2004. When this case came up for mention on 20 Disember 2004 both parties informed the court that they have settled the case amicably:-

TERMS OF SETTLEMENT

1. That the Company agrees to pay the Claimant a sum of RM 1,400.00, being two (2) months of the Claimant's last drawn salary, as full and final settlement of Industrial court Case No. 5/4-833/01.

2. That Claimant accepts the abovementioned sum and withdraws her claim against the Company in Industrial court Case No. 5/4-833/01 on the mention date scheduled on 20th December 2004.

3. That the Company pays the Claimant, through her solicitors, Messrs G. Siva Kumar & Associates, the abovementioned sum by 5.1.2005.

4. That the Claimant agrees that she has no further or other claims whatsoever against the Company arising out of her employment with the Company.

5. That the Company pays the abovementioned sum without any admission of liability whatsoever.

Case settled.
